1. Overview

This website is operated by CloudBorneCreations. Throughout these Terms, "I", "me", "my", or "we" refers to the sole proprietor owner of this store.

By using this site and placing an order, you agree to be bound by these Terms of Service.

2. General Conditions

I reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (excluding credit card information) may be transferred unencrypted and involve transmissions over various networks.

3. Products & Print on Demand

All products are made to order specifically for you. Because of this:

· Slight variations in color, size, and placement may occur between what you see on screen and the physical product
· Production times typically range from 2–7 business days before shipping
· I do not maintain inventory and cannot offer exchanges for size or color changes after an order is placed

4. Accuracy of Billing & Account Information

You agree to provide current, complete, and accurate purchase and account information for all orders.

You agree to promptly update your account and other information, including your email address and credit card numbers, so I can complete your transactions and contact you as needed.

5. Pricing & Modifications

Prices for products are subject to change without notice.

I reserve the right to modify or discontinue any product at any time.

I shall not be liable to you or any third party for any price change, modification, suspension, or discontinuance of any product.

6. Limitation of Liability 

To the maximum extent permitted by law:

· My total liability to you for any claim arising from your use of this site or purchase of products shall not exceed the total price you paid for the specific product giving rise to the claim
· I am not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, personal injury, or property damage
· This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise)

You agree that you are using this site and purchasing products at your own risk.

7. Indemnification

You agree to indemnify, defend, and hold harmless CloudBorneCreations from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of:

· Your breach of these Terms
· Your violation of any law or rights of a third party
· Any claim that your use of a product (such as a custom design you provided) infringes someone else's intellectual property

8. User-Generated Content (For Custom Designs)

If you upload your own artwork, logos, or designs:

· You warrant that you own the rights or have permission to use that content
· You agree to indemnify me against any copyright or trademark claims arising from your uploaded content
· I reserve the right to refuse or cancel any order containing content I determine, in my sole discretion, to be infringing, offensive, or unlawful

9. Shipping & Delivery

Estimated shipping times are provided as guidance only. I am not responsible for:

· Delays caused by shipping carriers, customs, or weather
· Lost or stolen packages marked "Delivered" by the carrier
· Incorrect addresses provided by you

10. Governing Law

These Terms of Service and any separate agreements whereby I provide you services shall be governed by and construed in accordance with the laws of New Jersey, without regard to its conflict of law principles.

Any legal disputes shall be resolved exclusively in the state or federal courts located in Burlington County, New Jersey, United States. 

11. Changes to Terms

I reserve the right to update or change these Terms at any time without prior notice. Your continued use of the website after any changes constitutes acceptance of those changes.
